JUSTICE RAJIV ROY ORAL ORDER 11-09-2023 Heard learned senior counsel for the petitioner as also Mr. Nikesh Kumar who represents the respondent No.2, the Deputy Development Commissioner (DDC) cum Chief Executive Officer, Zila Parishad, Sheohar.

2. The petitioner has come this Court for grant of following reliefs:- A. For commanding and directing the concern respondent authorities for the payment of arrear of salary to the petitioner which is due from 25.09.2003 to 01.06.2005 for which he is denied unreasonably and maliciously by ignoring the facts that petitioner who is employee under Zila Parishad,

Patna High Court CWJC No.8801 of 2019(2) dt.11-09-2023 2/3 Sheohar, holding post of 'Office Peon' whose suspension from service was revoked and given clean-chit in departmental proceeding vide Memo No.180 dated 01.06.2005 passed by the Deputy Development Commissioner (DDC) cum Chief Executive Officer, Zila Parishad, Sheohar, same and similarly situated person, namely, Sri Shivnath Singh got their arrear of salary vide order dated 09.08.2018 passed by the DDC, Sheohar but petitioner is discriminated among equal without any justification.

B. And for the other necessary relief/reliefs to the basis of the fact and circumstance hereinafter mentioned in the present writ application.

At the outset learned counsel appearing on behalf of respondent No.2 provided a copy of letter vide Memo No.351 dated 26.07.2023 issued by the respondent No.2 by which the payment for the said period has been made by Cheque No.044564 dated 18.02.2020 amounting to rupees seventy two thousand three hundred and one. The said letter is addressed to the Director, Home Department, Prosecution Directorate, Bihar, Patna.

4. A copy of the same has been provided. Let the same be kept on record.

5. In that view of the matter, the claim of the petitioner having been redressed, this Court disposes of the writ petition. If the petitioner still have some grievance he can agitate the matter.

6. With the aforesaid observation, the writ petition stands disposed of.
