2. After some argument, learned counsel for the petitioner submits that alternative remedy of filing appeal before the Divisional Commissioner is available to the petitioner but during pendency of the writ petition limitation has been crossed.

3. In this view of the matter, the present Writ Petition stands disposed off directing the petitioner to avail the remedy of appeal before the Divisional Commissioner and the Appellate Authority is directed that if there is any delay in filing the appeal, the same is directed to be condoned.
