The petitioners apprehend their arrest in connection with Bhabua Compliant Case No. 1169 of 2016 for the office registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that only because these petitioners had identified the said Chandrika Pandey, who is alleged to have fraudulently transacted in the sale of a piece of land which had been purchased by the complainant from the widow Bhabhi of the said Chandrika Pandey, the petitioners have been hauled up in connection with the present case. It is further submitted that

No.16433 of 2018 (2) dt.09-04-2018 so far as identifying the said Chandrika Pandey is concerned, these petitioners have, no doubt, placed their signature on the sale deed but the person concerned, namely, Chandrika Pandey has entered into the sale and, therefore, there is no offence on the part of these petitioners. It is further submitted that these petitioners have no concern with the sale transaction. Considering the aforesaid facts and circumstances of the case and that the petitioners have no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., V, Kaimur at Bhabua in connection with Complaint Case No. 1169 of 2016, subject to the condition as laid under Section 438(2) Cr.P.C.
