2. The petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 202 of 2022 registered under Sections 341, 323, 342, 504, 506, 307 and 379/34 of the Indian Penal Code.
3. On the alleged date and time of occurrence, petitioner along with other co-accused persons surrounded informant and this petitioner ordered to kill him and in the meantime coaccused Kunal Singh took away Rs. 70,000/- from the pocket of informant and also snatched golden chain. It is further alleged that this petitioner assaulted informant thrice with iron rod on his head with intention to kill him, due to which, informant
Patna High Court CR. MISC. No.28901 of 2024(3) dt.31-07-2024 2/2 fell down on the ground and the accused persons fled away.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. Further submission is that there is case and counter case between the parties. The doctor has found the injury simple in nature. Petitioner has got no criminal antecedent.
5. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Kalyanpur P.S. Case No. 202 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
