The petitioners seek bail in connection with Barbigha P.S. Case No. 08 of 2019 instituted for the offence under Section(s) 25(1-B)a/26(11)/35 of the Arms Act. It is alleged in the written report that police got information about illegal consignment of foreign liquor having been brought by the accused persons which are to be unloaded. The police reached Dariyachak Road near Khojagachhi More Pull (bridge). Thereafter, he found one truck, one bolero and one motorcycle was standing on the bridge and 8-10 persons were unloading cartoons from the truck who started running away on seeing the police party. Patna High Court CR. MISC. No.24295 of 2019(2) dt.16-04-2019 2/2 alleged that petitioners along with four other accused persons were arrested and other accused persons managed to run away. It is further alleged in the written report that one country made pistol with one live cartridge has been recovered from the Dickey of the Bolero car. In this manner, there is no recovery of incriminating articles from conscious possession of the petitioners.

Learned counsel for petitioners has submitted that separate case has been filed for recovery of foreign liquor against the petitioners.

Petitioners are in custody since 23.01.2019.

Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S.
