JUSTICE SUDHIR SINGH ORAL JUDGMENT Date: 30-06-2017 In the present writ application, the petitioner has sought direction for grant of revised pay scale of Rs. 5500-9000/- with effect from 01.01.1996 instead of pay scale of Rs. 4500-4700/-, in terms of the 5th Central Pay Commission, the replacement scale of Rs.16402900/- is Rs. 5500-9000/-. Petitioner was appointed as Artist-cum-Photographer on 26.03.1985 against the sanctioned and vacant post. After completion of 10 years of service, the petitioner got first time bound promotion with effect from 06.04.1995 and the petitioner was getting pay scale

Patna High Court CWJC No.6776 of 2011 dt.30-06-2017 2/2 of Rs. 1640-2900. After the pay revision under 5th Pay Commission, the petitioner is entitled for getting the pay scale of Rs. 5500-9000/- instead of a lower pay scale i.e. Rs.4500-7000/-, which has been granted to the petitioner.

The petitioner is directed to file a representation before the Director, Higher Education within a period of 8 weeks from the date of receipt of this order, who shall look into and examine the grievance of the petitioner and pass a reasoned order within a period of six months.

With the aforesaid liberty and the observation, the present writ application stands disposed of. It is made clear that this Court doesn't express any opinion about the merit of the present case. (Sudhir Singh, J) khushbu/- AFR/NAFR N.A.F.R.
