The petitioner is apprehending his arrest in connection with Bhabua P.S.Case No.650 of 2017 registered for offences punishable under Sections 419, 420, 468, 471 and 34 of the Indian Penal Code.

Allegation against the petitioner is that on his admit-card, he allowed another person to appear by replacing his photograph in the examination for recruitment of the constables. Submission of the learned counsel for the petitioner is that he was not arrested at the spot and after replacing his photograph one person appeared in the examination, for which the petitioner is not responsible.

Heard learned A.P.P. also, who has opposed the prayer for

Patna High Court Cr.Misc. No.23639 of 2018 (2) dt.20-04-2018 2/2 bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail, however, it appears that another co-accused person who has appeared in the examination has been granted regular bail, in such view of the matter, let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered on the fact that another accused person has been granted bail and the learned court below will dispose of the prayer for bail, if possible on the same day. With the aforesaid direction, this application is disposed of. (Vinod Kumar Sinha, J) chn/- U T
