Mr. GP19- RAJESH KUMAR CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL JUDGMENT Date : 23-03-2018 These three writ petitions have been filed by writ petitioners for direction to the respondent-authorities to appoint petitioners on Class-IV posts in Collectorate of Bhagalpur pursuant to advertisement dated 2.12.2001.
Counter affidavit has been filed by the Respondentauthorities in which they have stated that pursuant to different directions passed by the High Court, a panel in the year 2004 was prepared of 600 candidates and 588 of which have already been recommended for appointment against vacancies in Bhagalpur district and for remaining vacancies names have been recommended.
During pendency of the writ petition advertisement has been issued by the District Magistrate, Bhagalpur, for preparation of fresh panel against vacancy up to year 2016-17 and it has been submitted on behalf of petitioners that they have also submitted their application in the Employment Exchange for inclusion of their name in panel being prepared for appointment of Class-IV posts in terms of Advertisement.
4/4 It has been submitted on behalf of the petitioners that by order dated 2.2.2018 passed in CWJC No. 1550 of 2018 this Court has directed petitioners to file a representation before the District Magistrate, Bhagalpur, to consider their representation in accordance with law and they also pray that similar order may be passed in their case also.
In view of said submission, all the three writ petitions are disposed of in terms of order dated 2.2.2018 passed in CWJC No. 1550 of 2018.
" The learned counsel for the petitioner submits that the petitioner may be permitted to file a representation before the respondent No. 3 with regard to publication of final panel of Class IVth employee of Bhagalpur District in pursuance to advertisement dated 07.12.2016 and the Respondent No. 3 may be directed to decide the same within a specified time period.
In view of the aforesaid, it is directed that the petitioner may file a representation for redressal of his grievances before the respondent No. 3 within a period of four weeks from today and the respondent No. 3 shall pass a reasoned and speaking order within a period of six weeks thereafter and take the consequential action. The writ petition is disposed off in the aforesaid terms."
