ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.02.2019 in connection with Siwan Muffasil P.S. Case No.80 of 2019 registered for the offence under Sections 272, 273 and 308 of the Indian Penal Code and Section 30 and 41(i) of the Bihar Prohibition Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession but from a bush where the motorcycle was parked and therefore, the petitioner has been saddled with the said allegation. It is further submitted that the petitioner has got no criminal antecedent. In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on
