2. The petitioner seeks bail in connection with Nathnagar P.S. Case No. 264 of 2024, ST No. 830 of 2024 instituted for the offences under Sections 302, 120B, 201/34 of the Indian Penal Code.

3. Prosecution case, in short, is that, on the alleged date and time, the accused persons including the petitioner called the informant's husband. When the informant's husband did not return, she went to police station to lodge the FIR where she found the dead body of her husband.

4. Learned counsel for the petitioner submitted that the

Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. There is no eye-witness to the occurrence. Learned counsel further submitted that, as per the material that cropped up during investigation, co-accused Suraj Kumar in his confessional statement has stated that co-accused Indrajeet Mandal gave dabiya blow on the neck of the deceased. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.06.2024 and has one criminal antecedent.

5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that as per the material available in the case diary, co-accused Suraj Kumar, in his confessional statement has specifically narrated the manner in which he along with other accused persons including this petitioner committed the murder of the deceased. Learned APP further submitted that prayer for grant of bail of co-accused person has already been rejected by this Court vide order dated 28.01.2025 passed in Cr. Misc. No. 67581 of 2024. 6. Considering the aforesaid facts and circumstances of the case, nature and gravity of offence as also the material available in the case diary, this Court is not inclined to grant bail to the petitioner at this stage.

7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
