Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act.

Two liters of country made liquor is said to have been recovered from the half built house of the petitioner. Learned counsel appearing for the petitioner submits that the petitioner is innocent and no incriminating article has been recovered from conscious possession of the petitioner rather the recovery has been made from his house having no doors. He is no way concerned with the said recovery. In paragraph 3 of the bail petition it is stated that the petitioner has got no criminal antecedent.

Considering the facts of the case, in the event of

No.27236 of 2020(2) dt.21-10-2020 2/2 arrest/surrender, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, West Champran at Bettiah in Bettiah Mufasswil Police Station Case No. 710 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
