The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and sections 30(a), 38, 41 and 47 of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 554.1 litres of liquor is stated to have recovered from a vehicle and on enquiry, it was disclosed by the public that the four named accused persons including the petitioner herein had brought the same. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He was not arrested at the spot. He has neither any concern with the seized vehicle nor with the seized liquor. He is in custody since

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Sonepur P.S. Case no.582 of 2020 (Ex. Trial no.934 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran.
