The petitioner seeks bail in a case registered under Sections 394, 307 of the Indian Penal Code. Later on, Section 302 of I.P.C. has been added.

Allegation is that two unknown persons fired upon his friend, namely, Amit Kumar. The informant took his friend to Ruban Hospital, Patna, where he knew that his friend had bullet injury in his stomach and near left shoulder. Thereafter his friend was referred to Army Hospital for treatment. Later on, the victim Amit Kumar died in the Hospital.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.12.2018. Charge sheet has been submitted in this case. There is no allegation of tampering

Patna High Court CR. MISC. No.24614 of 2019(3) dt.07-05-2019 2/2 of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. Except for this, there is no other substantive evidence to suggest his implication in the present case. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge XII-cum-A.C.J.M., Patna in connection with Patliputra P.S. case No.544 of 2018.
