02. In the present case, the petitioner seeks bail in connection with Harsidhi P.S. Case No. 543 of 2022 registered for the alleged offences under Sections 304(B), 201/34 of the Indian Penal Code.

03. As per prosecution case, daughter of the informant was married with co-accused Vijay Prasad and they had a son. The allegation against petitioner and other co-accused persons is that they have been demanding Rs. 3,00,000/- and a motorcycle as dowry, torturing the daughter of the informant and threatening her with life. On 02.11.2022, the informant came to know that her daughter was killed and her dead body was disposed of by the petitioner and other co-accused persons. The

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is brother-in-law of deceased and he never demanded any dowry and allegation of demand of dowry is general and omnibus. The daughter of the informant died due to illness and the informant and her family members were present at the time of her death. The informant tried to blackmail the family member of the petitioner and being unsuccessful, lodged this false case against them. Learned counsel further submits that co-accused husband of the deceased is in custody since 22.02.2023 and some other co-accused persons have been granted bail by different Co-ordinate Benches vide order dated 08.08.2023 passed in Criminal Misc. No. 49682 of 2023 and order dated 25.09.2023 passed in Criminal Misc. No. 61796 of 2023, respectively. The petitioner is in custody since 10.11.2024, who is having clean antecedent. Charge-sheet has been submitted.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the

No.24741 of 2025(2) dt.30-04-2025 3/3 non-specific nature of allegation against the petitioner and further considering period of custody of the petitioner, his clean antecedent and submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari/court concerned in connection with Harsidhi P.S. Case No. 543 of 2022, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
