ANJANA MISHRA ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing for the Hindustan Petroleum Corporation Ltd. (HPCL).

It appears that in a collateral proceeding, the first

Patna High Court CWJC No.20227 of 2011 (5) dt.03-07-2017 2/2 empanelled candidate Sanjay Kumar has succeeded and vide judgment dated 01.05.2017 passed in CWJC No.17401 of 2011, the writ application of the first empanelled candidate has been allowed. The petitioner was the second empanelled candidate who has come to this Court seeking issuance of Letter of Intent (LOI) as he was the next in the panel so prepared by the HPCL. Now, in view of the fact that the first empanelled candidate has succeeded before this Court, the right of the second empanelled candidate does not subsist. As such, this writ application is rendered infructuous and is dismissed as infructuous.
