JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Runnisaidpur P.S. Case No. 450 of 2019 for the offences under Sections 30(a), 30(g), 38(ii), 41(i) and 41(ii) of the Bihar Prohibition & Excise Act, 2018.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. In the instant case total 2330.64 litres of liquor was seized from the truck.

Learned counsel for the petitioner submits that nothing was recovered from conscious possession of the petitioner and the truck in question does not belong to the petitioner. Petitioner is in custody since 30.04.2020.

No.27207 of 2020(2) dt.02-11-2020 2/2 Considering the fact that the petitioner has no criminal antecedent and he is in custody since 30.04.2020, the Court is inclined to grant bail to him subject to the condition that the petitioner has to deposit Rs.1,00,000/- in cash. On depositing the amount of Rs.1,00,000/-, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-II-cum-Special Judge (Excise), Sitamarhi in connection with Runnisaidpur P.S. Case No. 450 of 2019. Deposit of Rs.1,00,000/- (Rupees one lakh) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
