2. The petitioner apprehends her arrest in a case registered for the offence under Sections 406, 420, 467, 468, 471, 34 of the Indian Penal Code.
3. The informant alleged that co-accused Upendra Kumar had established a 'Lok Sewa Samiti Trust' near Naubatpur with the promise that if Rs. 5,000/- is donated he/she will be given Rs. 2,000/- per month from the trust and accordingly, they invested the amount but no such promise was fulfilled and accordingly, the present F.I.R. was lodged.
4. It is submitted on behalf of petitioner that petitioner has got no concern with the aforesaid trust. She has neither worked as staff nor acted as an agent. She is only alleged to have attended the seminar whereas co-accused Upendra Kumar is alleged to be founder of the trust, who has already been granted anticipatory bail vide order dated 17.01.2023 passed in
Patna High Court CR. MISC. No.26469 of 2023(3) dt.10-08-2023 2/2 Cr. Misc. No. 52714 of 2022. Petitioner is lady and has got clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Danapur, Patna in connection with Naubatpur P.S. Case No. 178/2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
