The petitioners are apprehending their arrest in connection with Barharia P.S.Case no.23 of 2019 , registered for offences punishable under Sections 420, 467, 468, 471, 380, 504, 34 of the Indian Penal Code.
In this case, the informant happens to be wife of the younger brother of the petitioner and the allegation is that the petitioner has sold the land of the share of the husband of the informant and when she protested they entered inside the house of the informant and abused and assaulted her and took away Rs.35,000/- .
Submission of the learned counsel for the petitioners is
Patna High Court CR. MISC. No.26474 of 2019(2) dt.24-04-2019 2/2 that the matter relates to property dispute between the family members and there is delay in lodging the FIR. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan, in connection with Barharia PS.Case No.23 of 2019, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
