JUSTICE RAMESH KUMAR DATTA) 29-11-2016 No one appears for the petitioners, which is an old matter, for restoration of C.W.J.C. No. 790 of 1991, which is alleged to have been dismissed in default by order, dated 19.02.1992, by a Division Bench of this Court. Office has reported that C.W.J.C. No. 790 of 1991 has never been dismissed prior to filing of the present restoration petition on 17.03.1992, therefore, the present M.J.C. petition is not maintainable.
In view of the aforesaid facts, the restoration petition is dismissed as not maintainable.
