This petition has been filed to modify the order dated 21-11-2017 passed in Cr. Misc. No. 53817 of 2017 in respect of petitioner No. 2 namely, Sudhir Prasad.

It has been submitted that the petitioner was granted anticipatory bail by the aforesaid order but he could not surrender in the court below within stipulated time as he had been suffering from illness and he was admitted in Tata Memorial Hospital, Mumbai.

In view of the aforesaid submission, this modification application is allowed to the extent that the time for surrender of the petitioner in the court below is extended for further four months from the date of receipt of the order. In the event, the

Patna High Court Cr.Misc. No.4058 of 2018 (2) dt.24-01-2018 2/2 petitioner surrenders in the court below within aforesaid period, in that event, he will be released on same terms and conditions as mentioned in the order dated 21-11-2017 passed in Cr. Misc. No. 53817 of 2017.

This modification application is, accordingly, disposed off.
