Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Chakai P.S. Case No. 58 of 2022 lodged under Sections 363, 364 and 365 of the I.P.C.

As per the prosecution case, the F.I.R. has been lodged against unknown persons alleging therein that the son of the informant was kidnapped.

Learned counsel for the petitioner submits that the present case is not related to kidnapping rather it is a case where the story of forceful marriage has transpired in the investigation. He further submits that the alleged victim boy has recovered from the house of one Dashrath Singh and thereafter his

Patna High Court CR. MISC. No.26459 of 2022(3) dt.12-09-2022 2/2 statement has taken place before the Magistrate under Section 164 in which he has not disclosed the name of the petitioner or any involvement of the present petitioner in the alleged kidnapping.

He further submits that petitioner is in custody since 15.03.2022, charge sheet has already been filed in this case having no criminal antecedent.

Learned counsel for the state submits that it is true that under Section 164, name of the petitioner has not come. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jamui in connection with Chakai P.S. Case No. 58 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
