JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-09-2023 The present writ petition has been filed seeking the following relief:- "1. That this writ application is being filed for issuance of appropriate writ / writs, order / orders, direction / directions to the Respondent authorities to grant promotion to the petitioner on the post of Superintending Engineer with the consequential benefit for which the petitioner is entitled for."

At the outset, the learned counsel for the RespondentState has referred to paragraphs no. 6 and 7 of the counter affidavit, filed in the present case, to submit that the petitioner

Patna High Court CWJC No.18907 of 2015(2) dt.27-09-2023 2/2 has been given additional charge of the post of Superintending Engineer (Mechanical), Irrigation Mechanical Circle, Gaya, Camp-Dehri, vide notification dated 26.12.2014, issued under the signature of Joint Secretary (Management), Water Resources Department, Bihar, Patna and thereafter, vide notification dated 27.1.2015, the petitioner has been granted additional charge of the post of Superintending Engineer (Mechanical), Irrigation Electrical-cum-Mechanical Circle, Patna. It is also submitted that the petitioner has already been granted the benefits of the assured career progression scheme, apart from him being paid salary in the pay-scale admissible to the post of the Superintending Engineer. Hence, it is submitted that in case of any subsisting grievances, the petitioner may approach the Respondent authorities.

Having regard to the aforesaid facts and circumstances of the case, not refuted by the petitioner, I deem it fit and proper to grant liberty to the petitioner to agitate his subsisting grievances, if any, before the Respondent authorities.
