Petitioner apprehends arrest in a case registered for the offence punishable under Sections 363, 365 and 366 of the Indian Penal Code.
As per the prosecution case, on 25.07.2019 at about 11 A.M. accused Rajdeo Kumar with the help of his family members including the petitioner eloped the daughter of the informant and threatened to kill her.
It is submitted on behalf of the petitioner that petitioner is the elder brother of the accused Rajdeo Kumar and the allegation against the petitioner is false, baseless and concocted one. It is further submitted that, in fact, co-accused, Rajdeo Kumar has already solemnized marriage with the victim
Patna High Court CR. MISC. No.27229 of 2020(3) dt.12-11-2020 2/2 girl on 02.08.2019 at Masaurhi Court Shiv Mandir and after marriage they also filed affidavit which was Annexure No.3 in the bail petition. It is further submitted that co-accused persons have already been granted bail vide order dated 15.11.2019 passed in Cr. Misc. No. 69594 of 2019 and vide order dated 11.12.2019 passed in Cr. Misc. No. 82074 of 2019 by this Hon'ble Court which is Annexure No. 4 to this bail petition. It is stated by learned counsel for the petitioner in paragraph 3 of the bail petition that petitioner has got no criminal antecedent. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. In the even of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st, Masaurhi, Patna, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
