This is 2nd attempt for bail on behalf of the petitioner in connection with Alauli P.S. Case No. 443 / 2019, G.R. No. 3690 / 2019 registered for the offence under Section 392 of the I.P.C. inasmuch as earlier bail application of the petitioner was dismissed as withdrawn vide Cr. Misc. No. 35332 of 2021 with liberty to the petitioner to renew his prayer for bail after three months.

Allegation as per the prosecution story is that the petitioner along with other co-accused persons intercepted the informant and snatched Rs. 15,000/-, ATM Card, Aadhaar Card etc. on gun point. The petitioner is in custody since 02-05-2020 .

No.26199 of 2022(2) dt.22-06-2022 2/2 Regard being had to the submissions made by the parties and taking into consideration the fact that petitioner is in custody since 02/05/2020, this is 2nd attempt for bail on behalf of the petitioner and the offence is triable by Magistrate, as such, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 443 / 2019, G.R. No. 3690 of 2019.
