JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,448,341,323,324,307,379 and 504 of the Indian Penal Code.
It is alleged that the accused persons including the petitioners came variously armed, assaulted the informant when wife and son of informant came to rescue, they were also assaulted.
It is submitted by the learned counsel for the petitioners that in the background of land dispute the accusation has been levelled. Though injuries of one of the injured have been found to
Patna High Court Cr.Misc. No.53128 of 2015 (2) dt.23-11-2015 2/2 be grievous but there is counter version of the occurrence when the petitioners side also received injury.
It is submitted by learned counsel for the state that the son of the informant also received grievous injury. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioners in case the petitioners surrender within six weeks from today in connection with Hathua P.S. Case No. 131 of 2015 pending in the court of learned J.M. Ist Class, Gopalganj.
This application is disposed of with the aforesaid observation/direction.
