JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Jamalpur (Badgaw O.P.) P.S. Case No. 74 of 2017 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

The allegation against the accused persons is strangulating the grand daughter of the informant on account of non-fulfillment of the demand of dowry.

The learned counsel for the petitioners submits that the petitioners are the mother-in-law and father-in-law of the deceased and the husband is already in custody. It is further submitted that the petitioners herein are separate in mess and

Having regard to the facts and circumstances of the of the case, more particularly the fact that the husband is in custody, I deem it fit and proper to enlarge the petitioners herein on anticipatory bail in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Biraul, Darbhanga in connection with Jamalpur (Badgaw O.P.) P.S. Case No. 74 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) S.Sb/- U T
