====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 27-04-2023 Heard learned counsel for the petitioner and learned counsel for the State.

The present Cr. Writ Petition has been filed for quashing of F.I.R. bearing Mithanpura P.S. Case No. 284 of 2021 dated 24.12.2021 lodged under Section 420, 406/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that

Patna High Court CR. WJC No.571 of 2022(2) dt.27-04-2023 2/2 petitioner is working in a private organization and the allegation made against him is based on the personal grievances and personal dispute with the informant. He is not the official who suppose to put question that how the petitioner has collected money in the account of his wife.

Learned counsel for the State submits that there is a direct allegation against the petitioner that he use to take commission for the work doing on behalf of his employer. In the present facts and circumstances, this Court upon going through the F.I.R. founds the allegation to be true and, therefore, at this juncture not inclined to interfere and of the view that investigation is necessary in this case. Accordingly, the present Cr. Writ Petition stands dismissed with liberty to the petitioner that when material of the investigation shall come, he has remedy to raise his matter before appropriate forum at appropriate stage.
