====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 20.11.2018 in a case for the offence registered under Sections 401, 414, 384 and 212/34 of the IPC.

The prosecution story, in brief, is that the police proceeded to arrest Pappu Singh who was allegedly realizing Rangadari of Balu Ghats. The police raided the village and started making search. It is further alleged that Pappu Singh and other accused persons fled away taking advantage of darkness but their associates, namely, Pankaj Kumar, Vinod Kumar, Niwash Kumar, Sikandar Paswan, Gopal Mandal, Pappu Paswan and Krishnand Paswan (petitioner) were arrested and search was made in presence of witnesses, Mobile, Motorcycle

Patna High Court CR. MISC. No.27067 of 2019(2) dt.25-04-2019 2/2 etc. were seized.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The matter relates to illegal mining of sand. The petitioner denies the allegation made in the F.I.R. Other coaccused has been granted bail by another Co-ordinate Bench of the Court vide Cr. Misc. No. 23429 of 2019 order dated 11.04.2019.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
