JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-07-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The present petition has been filed seeking modification of the order dated 29.02.2020 passed in Criminal Misc. No. 8687 of 2020 to the extent that the time granted to the petitioner to surrender before the learned court of Sub JudgeXIV-cum-Additional Chief Judicial Magistrate-XIII, Muzaffarpur in connection with Aurai P.S. Case No. 273 of 2019, be extended by a further period of four weeks from today. The learned counsel for the petitioner has submitted that on account of the prevailing situation due to

Patna High Court CR. MISC. No.35792 of 2021(2) dt.29-07-2021 2/2 Covid-19 pandemic, the petitioners could not surrender before the learned court below within the time stipulated by this Court, hence a sympathetic view may be taken.

The learned APP for the State Mr. Nagendra Prasad does not oppose the present petition.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, the present petition stands allowed and the aforesaid order dated 29.02.2020 passed in Criminal Misc. No. 8687 of 2020 stands modified to the extent that the petitioner shall now be entitled to surrender before the learned court of Sub Judge-XIV-cum-Additional Chief Judicial Magistrate-XIII, Muzaffarpur ,within a further period of four weeks from today.

The petition stands disposed off on the aforesaid terms.
