The petitioner apprehends his arrest in connection with Madhubani Town P.S. Case No. 207 of 2016 registered under Sections 379, 411, 414, 401, 403 and 413/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that Mukesh Ram, who was apprehended by the Police with looted motorcycle, disclosed the name of Govind Ram, Pappu Ram and Surya Ram, having hand in loot of the motorcycles and he further disclosed that one motorcycle is sold to this petitioner on consideration of Rs. 12000/-. Accordingly, one motorcycle was recovered from the house of the petitioner. In fact, the motorcycle,
Patna High Court Cr.Misc. No.43585 of 2016 (2) dt.18-10-2016 2/2 which is said to be recovered from the house of the petitioner, was purchased by the petitioner, but the petitioner had no knowledge that the said motorcycle was stolen by Mukesh Ram. Further, submission is that petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Madhubani in connection with Madhubani Town P.S. Case No. 207 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
