The petitioner apprehends his arrest in Rajauli P.S. Case No. 477 of 2021, registered for the offence punishable under Sections 30(a), 30(d) and 41 of the Bihar Prohibition and Excise Act, 2016.

130 litres of country made Mahua liquor has been recovered near river.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open place which is accessible to general public and petitioner has got no concern with the alleged recovery. Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent

Patna High Court CR. MISC. No.26137 of 2022(2) dt.05-08-2022 2/2 of similar nature.

Considering the criminal antecedents of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail.
