Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 379, 308, 354, 504, 509/34 of the Indian Penal Code.
The prosecution case is that when the informant was returning on a bicycle the petitioner outrage her modesty. Earlier also the petitioner chase and used to indecent language to the informant. The mother of the informant went to protest then the eptitioenr assaulted her. The brother of the informant was also assaulted by this petitioner. It is further alleged that this petitioner assaulted and snatched gold chain from the mother of the informant.
Patna High Court Cr.Misc. No.55437 of 2015 (2) dt.16-12-2015 It is submitted by the learned counsel for the petitioner that for petty dispute accusation has been levelled and from the accusation levelled in the First Information Report no any offence under Section 354 and 308 of the Indian Penal Code is made out.
Considering the nature of accusation and the statement made in para 3 of the petition that petitioner has no criminal antecedent, it is a case for consideration of regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Desari P.S. Case No. 172 of 2015, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.
With the above observation this application is disposed of.
