JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Karpi P.S. Case No. 52 of 2017, dated 16.03.2017, instituted for the offences punishable under Sections 408, 420, 419, 467, 468, 471, 472 and 34 of the Indian Penal Code.

The petitioner is alleged to be one of the members of the committee which had appointed contractual teachers, some of whom are said to have furnished fake certificates.

Learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.15950 of 2018 (2) dt.06-04-2018 2/2 that the petitioner was only one of the members of the committee and the committee did not have any methodology of finding out whether the marks-sheets of the candidates were genuine or forged. There is no allegation in the First Information Report or in the investigation papers, as has been argued on behalf of the petitioner, that knowingly that the marks-sheets offered by the contractual teachers were forged, they were appointed.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Arwal in connection with Karpi P.S. Case No. 52 of 2017.
