JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-08-2017 The peremptory order of this Court, dated 09.05.2017, has not been complied with within time inasmuch as substitution petition in respect of deceased respondent nos. 3 and 8, as well as requisites under both processes for issuance of show cause notice on respondent nos. 1, 2, 5, 6, 7 and 9, in the matter of limitation, has not been filed.

There is no representation on behalf of the appellant. From the Office Note, it appears that I. A. No. 2160 of 2013 stood dismissed as against the said respondent nos. 1, 2, 5, 6, 7 and 9 and heirs of deceased respondent nos. 3 and 8. Under such circumstances, it has been rightly pointed out by the Office that the appeal stands dismissed as time barred in the absence of any limitation petition.
