The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 of the Indian Penal Code and 27 of the Arms Act. It is alleged that the firing was made by Amod Kunwar and this petitioner in the air causing injury to the informant's right hand.
It is submitted by learned counsel for the petitioner that from the accusation itself it appears that no offence under Section 307 IPC is made out. Moreover, injury has been found caused by firearm. The petitioner has been roped in the present case only because he is related to Amod Kunwar.
Patna High Court Cr.Misc. No.53177 of 2015 (2) dt.24-11-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Phulwaria P.S. Case No. 48 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Gopalganj.
With the aforesaid observation, this application is disposed of.
