Petitioner seeks bail in Buxar (T) P.S. Case No.163 of 2020 registered under Section 414 of the IPC and under Sections 25(1-b)a, 26 and 35 of the Arms Act. The police intercepted a motorcycle on which three persons were boarding and on such, they were apprehended. They disclosed their names as Niraj Yadav, Bittu Pandey and Sandeep Kumar Rai (petitioner). On search, one loaded country made pistol was recovered from Niraj Yadav. One mobile, photocopy of Identity Card of Nirmal Rai, Aadhar Card and Rs.500/- cash were recovered from possession of the petitioner. Learned counsel for the petitioner submits that one loaded country made pistol was recovered from Niraj Yadav. Petitioner has no manner of concern about the motorcycle. The

Having considered the facts and the nature of allegations made against the petitioner and the fact that the petitioner is in jail since 10.04.2020, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st, Buxar in connection with Buxar (T) P.S. Case No.163 of 2020.
