ANJANA MISHRA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.03.2019 in connection with Maniyari P.S. Case No.369 of 2018, G.R. No.10 of 2019 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the allegation is that 222.480 ml. illicit liquor was recovered from the house of the petitioner, but the house does not belong to the exclusive possession of the petitioner and he has been falsely implicated in the present case. It is further submitted that the petitioner is a student and pursuing his studies and shall be seriously prejudiced if he is confined in jail.
