JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 326, 307, 147, 148, 149, 504, 506, 379 of the Indian Penal Code.

It is alleged that in the background of land dispute the petitioner assaulted with Farsa to Sona Devi on her head while co-accused Kishori Prasad assaulted to the informant with Fasuli on his head.

It is submitted by learned counsel for the petitioner that though the accusation has been levelled that seven persons assaulted Sona Devi but she received only one injury on scalp, caused by sharp cutting weapon, though grievous in nature. Moreover the accusation has been levelled in the background of land dispute.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.53224 of 2015 (2) dt.26-11-2015 2/2 consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Paharpur P.S. Case No. 66 of 2014, pending in the Court of learned Chief Judicial Magistrate, Motihari, East Champaran. With the observations above, the application stands disposed off.
