JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 137 of 2018, disclosing offences under Sections 498A of the Indian Penal Code . Petitioner happens to be husband of the complainant and allegation against the petitioner is of demand of Rs. Five Lakh and Hero Honda motorcyle from the complainant as dowry and on non fulfilment of the said demand, the complainant was subjected to cruelty and torture. Submission of learned counsel for the petitioner is that entire allegation is false and concocted and he is still ready to keep the complainant with full honour and dignity.

No.23964 of 2019(6) dt.11-09-2019 2/2 It appears that on appearance of opposite party no. 2, the matter was referred to District Mediation Center, Sasaram, Rohtas for mediation, but the report of learned Mediator shows that the parties did not appear before the Mediator and as such the mediation could not be initiated.

Nobody appears on behalf of opposite party no. 2. Heard learned A.P.P. also.

In view of the submission of learned counsel for the petitioner, this application is disposed of with direction to him to appear in the court below on 26.09.2019 and on appearance, the court below shall extend the provisional bail of the petitioner for further period of six months and during the aforesaid period of six months, the court below shall issue notice to opposite party no. 2 - Complainant and enquire from her as to whether, she wants to reside with the petitioner and after considering the same, the court below shall pass an appropriate order either confirming the bail bonds of the petitioner or cancelling the same.
