JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 06-04-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Khushrupur P.S.Case No. 179 of 2017 registered under Sections 363 and 366-A of the Indian Penal Code. The allegation in the FIR is that one Deepak Kumar, son of the petitioners, enticed away minor daughter of the informant and both of them are traceless. It is further alleged by the informant that the petitioners being parents of said Deepak Kumar are in know of the whereabouts of the victim. Learned counsel for the petitioner submitted that the petitioners have been implicated in this case without any rhyme or

Patna High Court Cr.Misc. No.18571 of 2018 (2) dt.06-04-2018 2/2 reason. They cannot be held responsible for any act of omission or commission on the part of their son. They are not aware of the whereabouts of the victim or even their son.

Having regard to the nature of allegation made in the FIR and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City in connection with Khushrupur P.S.Case No. 179 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
