The petitioner is apprehending his arrest in connection with Sherghati P.S.Case No.700/2017 registered for offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner, as per FIR is that 50 ltrs. liquor has been recovered from his 'Bari'.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his house and further though he is accused in one more case but in that case he has been made accused on the basis of confession.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.3592 of 2018 (2) dt.01-02-2018 2/2 circumstances, as stated above, this is not a case of grant of anticipatory bail rather let the petitioner surrender before the court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit and also considering the quantity of the liquor recovered, he will pass an appropriate order on the same day.

With the aforesaid observation, this application is disposed of.
