The petitioner seeks bail in anticipation of his arrest in connection with Mohania P.S. Case No. 482 of 2017 dated 06.09.2017 instituted for the offences under Sections 409/420 of the Indian Penal Code.
The petitioner, by concealing information regarding his having a mud house and his son being in service; obtained financial assistance under the Prime Minister Scheme for landless and homeless. When this was detected, the petitioner was asked to deposit Rs. 55,000/-, the amount of money which he had received from the Government Agency. He started dilly-dallying in returning the money. Hence the F.I.R.
Learned counsel for the petitioner has
Patna High Court Cr.Misc. No.21411 of 2018(2) dt.26-04-2018 2/2 submitted that the petitioner has already deposited Rs. 55,000/-, which was received by him under the government scheme.
Considering the aforesaid fact, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand)/each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 482 of 2017 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) Krishna/- Sneha U T
