JUSTICE SUDHIR SINGH ORAL ORDER 05-07-2017 Learned counsel for the petitioner seeks permission to withdraw the present application with a liberty to prefer an appeal before the State Appellate Authority challenging the order passed by the District Appellate Authority, Gaya.
Permission is accorded.
The petitioner shall file an appeal before the State Appellate Authority within a period of thirty days from the date of the order and the same shall be disposed of on its own merit in
Patna High Court CWJC No.19565 of 2010 (8) dt.05-07-2017 2/2 accordance with law within the statutory period. It has been pointed out by the learned counsel for the petitioner that vide order dated 05.07.2011, the Hon'ble High Court had stayed the order passed by the District Appellate Authority. The petitioner will be at liberty to make a separate application for grant of interim order during the pendency of the appeal.
The present application is disposed of with the aforesaid observation and direction.
