JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No. 25 of 2017, registered under Section 380 of the Indian Penal Code, pending in the court of Judicial Magistrate Ist Class, Patna City, Patna. The allegation of informant, Kundan Kumar Sudhanshu, is that he used to reside in the rented house of Smt. Viddya Devi, New Kunj Colony, Bahadurpur, Patna, in connection with the study. On 18.02.2017, when he was returning after taking meal then saw that this petitioner was moving near the room along with Laptop. When he entered in his room then found that his Laptop was found missing.

No.39827 of 2017 (2) dt.15-09-2017 Learned counsel for the petitioner submits petitioner has falsely been implicated in this case mere on suspicion and nothing has been recovered from his possession. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
