The petitioner is in custody since 03.12.2018 in connection with Bhawanipur (Akbarpur) P.S. Case No. 227 of 2018 for the offence registered under Sections 147, 148, 149, 341, 323, 324 and 302 of the Indian Penal Code. Learned counsel for the petitioner submits that so far as the present petitioner is concerned, it is alleged that he had assaulted the son of deceased, namely, Jawahar Singh with Bhalla on his hand but the injuries have been found to be simple in nature and, therefore, he may be extended the privilege of bail.

Diary of the present case was called for which has since been received.

Learned counsel for the State has pointed out at

Patna High Court CR. MISC. No.24087 of 2019(5) dt.01-10-2019 2/2 paragraph 33 of the case diary wherein it has been found that both the injuries on the Jawahar Singh have been found to be simple in nature.

Considering the aforesaid facts and circumstances of the case and that the allegation against the petitioner is of having attacked the Jawahar Singh and not Sourabh Singh @ Chhotu Singh (deceased), let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Purnea in connection with Bhawanipur (Akbarpur) P.S. Case No. 227 of 2018.
