2. This application is for grant of regular bail in connection with N.D.P.S. Case No.40 of 2024 arising out of Udwantnagar P.S. Case No.261 of 2024, registered for the offences under Sections 8(c), 20b(ii) (B) of the NDPS Act and Sections 25(1-B0 (a), 26 & 35 of the Arms Act.

3. As per the F.I.R., 2.125 kg of ganja and two cartridges has been recovered from a vehicle.

4. The petitioner is in custody since 21.06.2024 and he claims clean antecedent.

5. Considering the facts and circumstances of the case, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with

Patna High Court CR. MISC. No.26828 of 2025(2) dt.05-05-2025 2/2 two sureties of the like amount each to the satisfaction of the learned Special Judge-NDPS-cum-Sessions Judge, Bhojpur at Ara/concerned Court below, in connection with Udwantnagar P.S. Case No.261 of 2024.

7. At the time of accepting the bail bonds of the petitioner, the Court below shall verify the fact whether the petitioner has clean antecedent or not. If it is found that the petitioner has clean antecedent then only his bail bonds shall be accepted by the Court below.

8. One of the bailor will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner.

9. This is also subject to the condition that the petitioner shall mark his attendance at Udwantnagar Police Station, Bhojpur at Ara on every Sunday of each month. Any default in appearance at the police station would result in the cancellation of bail bonds of the petitioner.
