The petitioner apprehends his arrest in connection with Compliant Case No. 2045 (C) of 2015, registered under Sections 323, 448, 504, 471, 468, 467 and 420 of the Indian Penal Code. The accusation is that in spite of the partition of the land in between complainant and his two brothers in the life time of their father his brother Manu Singh (Petitioner) and Sudhir Singh got prepared the partition deed putting his forged signature and got mutated their names in respect to some land of his share. Thereafter, petitioner challenged the mutation order vide Appeal

Patna High Court Cr.Misc. No.48444 of 2017 (2) dt.16-10-2017 2/2 bearing No. 18 of 2014-15 on making complaint petitioner and Sudhir Singh also assaulted to complainant.

Learned counsel for the petitioner submits that, in fact, registered partition deed was prepared on the consent of the petitioner and his brother Sudhir Singh and the complainant Ravi Ranjan Singh, but with ulterior motive, the present case has been lodged. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Complaint Case No. 2045 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
