Petitioner seeks regular bail in connection with Excise Case No. 254/2021 arising out of Excise Department PR Case No.33/2020-21 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise Act 2016. As per, prosecution case, the Excise Officials on the basis of secret information, intercepted a car bearing Registration No. BR24H0721 being driven by the petitioner and recovered total quantity of 149.745 litres of illicit liquors. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged

Patna High Court CR. MISC. No.33547 of 2021(2) dt.20-12-2021 2/2 and the petitioner is not the owner of the car and the same was being driven by him at the instance of its owner. Learned counsel for the petitioner further submits that petitioner is in custody since 10.03.2021 and the charge-sheet has already been submitted.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is not the owner of the car, he is in custody since 10.03.2021 and the charge-sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, PRAMENDRA PASWAN be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, (Excise) Kaimur at Bhabhua in connection with Excise Case No. 254/2021 arising out of Excise Department PR Case No.33/2020-21.
