1. The present writ petition has been filed seeking the following relief(s):- "1. That this is an application for issuance of appropriate writ, order or direction directing the respondents authorities to adjust the petitioners who instructors under adult and non-formal education against the suitable post by way of

Patna High Court CWJC No.7145 of 2022(2) dt.12-12-2023 2/3 absorption in regular Government Services and has been done into case of Non-Formal Supervisors and in the light of order passed in CWJC No.8418/2010 affirmed in L.P.A. No. 1489/2011. The Hon'ble Apex Court vide S.L.P. Case No.32079 of 2015. On this basis according to the Principal Secretary, Education Department, Bihar Government letter No.934 dated 14.04.2016 not accepting the application because they have not approach the court till 26.02.2016 M.J.C. No. 1999/2013 and CWJC No. 13901/2008 order dated 09.01.2017 passed by Hon'ble Apex Court S.L.P. Case No.21961/2017 arising out of impugned final judgment and order dated 04.08.2017 in M.J.C. No.809/2012 passed by the High Court of Judicature at Patna. Recently a number of C.W.J.C. cases are awaiting for Apex Court dated 08.02.2018 by Hon'ble Court. Apex Court in S.L.P. Case No.25804/ 2017 passed order dated 02.12.2021.

Instructors were also absorbed in the Grade-IV Government Service.

Authorities are not accepting petitioners while he has not approached any court. Above petitioners have worked in the same programme organized by Non- Formal Education Department of Bihar, Government from 18.04.1996 to 31.03.2001. Similarly to those instructors as has been absorbed on direction of this Hon'ble Court."

2. At the outset, the learned counsel for the respondent-State submits that in view of the judgment rendered by the learned Division Bench of this Court in Civil Review No.59 of 2018, the present petition has been rendered infructuous, which is not disputed.
