The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 333, 504 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that in the background of land dispute the accused persons including the petitioner abused and assaulted the informant. On protest being made by the informant they started pelting stones, co-accused Kariya Singh took licensed weapon of the petitioner and at the instigation of the petitioner co-accused Kariya Singh fired causing injury to the informant.

No.53179 of 2015 (2) dt.24-11-2015 2/2 It is submitted by learned counsel for the petitioner that the specific overt act has been alleged against Kariya Singh and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Barahara P.S. Case No. 236 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
